RESOLUTION

ON THE TEMPORARY SUSPENSION OF EFFECT AND ADJUSTMENT OF THE IMPLEMENTATION TIMELINE OF GOVERNMENT DECREE NO. 46/2026/ND-CP DATED 26 JANUARY 2026 DETAILING A NUMBER OF ARTICLES AND MEASURES FOR THE ORGANIZATION AND IMPLEMENTATION OF THE LAW ON FOOD SAFETY, AND RESOLUTION NO. 66.13/2026/NQ-CP DATED 27 JANUARY 2026 ON THE ANNOUNCEMENT AND REGISTRATION OF FOOD PRODUCTS

Pursuant to the Law on Organization of the Government No. 63/2025/QH15;

Pursuant to the Law on Promulgation of Legal Normative Documents No. 64/2025/QH15 as amended and supplemented by Law No. 87/2025/QH15;

At the proposal of the Ministers of Health; Agriculture and Environment; Industry and Trade; and Justice;

The Government hereby promulgates the Resolution on the temporary suspension of effect and adjustment of the implementation timeline of Decree No. 46/2026/ND-CP dated 26 January 2026 and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026.

Article 1. Temporary Suspension of Effect and Adjustment of Implementation Timeline

1. The effect of Government Decree No. 46/2026/ND-CP dated 26 January 2026 detailing a number of articles and measures for the organization and implementation of the Law on Food Safety, and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 on the announcement and registration of food products, is hereby temporarily suspended until the end of 15 April 2026.
2. Government Decree No. 46/2026/ND-CP dated 26 January 2026 detailing a number of articles and measures for the organization and implementation of the Law on Food Safety, and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 on the announcement and registration of food products, shall resume effect from 16 April 2026.

Article 2. Application of Legal Normative Documents During the Period of Suspension

During the period of temporary suspension prescribed in Article 1 of this Resolution, Government Decree No. 15/2018/ND-CP dated 02 February 2018 detailing a number of articles of the Law on Food Safety, and the legal documents providing guidance for the implementation of this Decree, shall continue to remain in effect.

Article 3. Effectiveness and Responsibilities for Implementation

1. This Resolution takes effect from 04 February 2026.
2. Prior to 16 April 2026, the Ministries of Health; Agriculture and Environment; Industry and Trade; Finance; other relevant ministries and agencies; and People’s Committees at all levels shall be responsible for ensuring all necessary conditions for the implementation of Government Decree No. 46/2026/ND-CP dated 26 January 2026 and Resolution No. 66.13/2026/NQ-CP dated 27 January 2026 on the announcement and registration of food products.

• Ministries, ministerial-level agencies, and government-attached agencies;
• People’s Councils and People’s Committees of provinces and centrally governed cities;
• Office of the Party Central Committee and Party Commissions;
• Office of the General Secretary;
• Office of the President;
• Office of the National Assembly;
• Council for Ethnic Affairs and Committees of the National Assembly;
• Supreme People’s Court;
• Supreme People’s Procuracy;
• State Audit Office of Vietnam;
• Central Committee of the Vietnam Fatherland Front;
• Central agencies of socio-political organizations;
• Government Office: Minister-Chairperson, Vice Chairpersons, Assistants to the Prime Minister, Director General of the Government Portal, Departments, Bureaus, affiliated units, Official Gazette;
• Archives: Administration, Culture–Social Affairs Department (2).
